Property lawyer in Vienna

I advise and represent private individuals, businesses and property owners in all major areas of property and construction law.

A particular focus of my work is disputes between co-owners of real estate. I represent clients in both enforcing and defending claims and have extensive experience of partition actions, exclusion actions and disputes concerning the assessment of unit values and condominium ownership.

I also assist with property transactions, developments and construction projects and represent clients in litigation relating to property and building projects.

Disputes between co-owners

Joint property ownership often leads to conflict, for example after an inheritance or separation, or when the owners' interests diverge over time. I advise and represent co-owners particularly in:

  • partition actions and dissolution of co-ownership;
  • defending partition actions;
  • actions to exclude other co-owners;
  • disputes about the use and management of jointly owned property;
  • problems with the assessment of relative unit values (Parifizierung or Nutzwertfestsetzung);
  • establishing condominium ownership (Wohnungseigentum);
  • disputes about investment, costs and maintenance;
  • reviewing waivers of partition, continuation agreements and prohibitions on sale or encumbrance.

Disputes between co-owners often depend on more than the current land register entries. Purchase, gift or transfer agreements made decades ago, and agreements between the owners, may also be decisive.

Property purchases and transactions

I also assist clients with buying and selling property and with gifts and transfers. My work includes:

  • purchase and gift agreements;
  • property transfer agreements;
  • escrow arrangements;
  • registration of property transactions in the land register;
  • reviewing existing registered encumbrances;
  • condominium agreements;
  • legal support for property development.

Careful contract drafting aims to identify and avoid legal risks before a property transaction is concluded.

Construction law and litigation

Another focus is legal support for construction projects and construction litigation. I represent developers, customers and businesses particularly in disputes about:

  • construction defects;
  • claims for payment for works;
  • additional costs and variations;
  • construction delays;
  • damages claims;
  • statutory warranty claims;
  • interpretation of construction and works contracts.

Especially in substantial construction disputes, it is important to bring together technical processes, contractual terms and project documentation at an early stage.

Further areas of property law

I also advise and represent clients particularly in the following areas:

  • acquisition and sale of real estate;
  • gifts and transfers of property;
  • escrow arrangements;
  • property development;
  • project finance;
  • property developer contract law;
  • construction law and construction contracts;
  • estate agency law;
  • tenancy and housing law;
  • establishing condominium ownership;
  • drafting contracts;
  • land register matters.

Personal advice on property law

Property disputes often involve substantial assets and can develop over many years. An early legal assessment can therefore be decisive, particularly before bringing a partition action, signing a property agreement or commencing substantial construction litigation.

I advise you personally and represent your interests both out of court and in litigation.
