Vehicle lawyer and trained motor mechanic
Legal disputes about vehicles often depend as much on technical details as on the legal position.
I am a lawyer specialising in vehicle law and a trained motor mechanic. This enables me to assess technical vehicle defects, repair reports and expert opinions from both a legal and a technical perspective.
A particular focus of my practice is reversing vehicle purchase contracts. I represent buyers seeking to return defective cars or motorcycles and recover the purchase price, as well as sellers and automotive businesses facing rescission or statutory warranty claims.
Reversing a car purchase: when can I return my car?
Have you bought a car or motorcycle and discovered serious defects shortly afterwards? Typical cases in my practice include:
- engine or gearbox damage;
- unusually high oil consumption;
- undisclosed or misrepresented accident damage;
- tampered odometer readings;
- serious rust or corrosion;
- problems with electric vehicles or the traction battery;
- recurring defects despite repair attempts;
- departures from expressly promised vehicle characteristics.
Depending on the facts, claims may arise under statutory warranty law, avoidance for mistake or other civil-law grounds. Serious defects may, subject to the relevant conditions, entitle you to cancellation or reversal of the purchase contract.
The vehicle is then returned and the seller must generally refund the purchase price. Whether, and to what extent, usage compensation for kilometres already driven is to be deducted must be examined separately in each case.
Can a private purchase also be reversed?
It may also be possible to reverse the purchase of a used car from a private individual. Although statutory warranty is often contractually excluded in private sales, such an exclusion does not automatically mean that no claims remain.
Other remedies may be available particularly where incorrect statements were made about essential characteristics, such as accident history, mileage or particular technical features. The purchase contract should therefore be examined together with the advertisement, messages exchanged between buyer and seller, and available technical documents.
Vehicle buyers and sellers
I do not represent buyers alone. Private sellers, car dealers and other automotive businesses also regularly face demands for warranty remedies, price reductions or reversal of a sale. Not every technical problem arising after a sale automatically makes the seller liable.
Key questions often include:
- What condition of the vehicle was contractually agreed?
- Did the alleged defect exist at delivery?
- Could it be normal wear and tear?
- What statements appeared in the contract or advertisement?
- What repairs have already been carried out?
- What does a technical expert report establish?
I therefore represent both buyers enforcing reversal of a purchase and sellers defending unjustified claims.
Your advantage: lawyer and motor mechanic in one person
Technical expert evidence often plays a central role in vehicle litigation. Before becoming a lawyer, I trained as a motor mechanic. This allows me to understand technical explanations and expert reports professionally and identify the decisive technical questions early in proceedings.
This is particularly useful in disputes about engine and gearbox damage, oil consumption, previous accident damage, wear and tear, repair quality or the technical condition of a used car. Legal and technical questions are therefore considered together.
Further areas of vehicle law
Alongside reversing vehicle purchases, I assist particularly with:
- statutory warranty disputes following the purchase of a car or motorcycle;
- disputes over contractual guarantees;
- legal problems between repair workshops and customers;
- defective or incorrect repairs;
- disputes with car dealers;
- problems involving leased vehicles and leasing companies;
- road traffic accidents and damages claims;
- personal injury and compensation for pain and suffering after traffic accidents;
- disputes with insurers following an accident.
What should you have ready for an initial review?
For a vehicle purchase, the following documents are particularly helpful:
- purchase contract;
- original advertisement;
- messages or emails exchanged with the seller;
- workshop invoices and repair reports;
- inspection reports and Austrian section 57a roadworthiness reports;
- existing expert reports;
- photographs or videos of the defect.
The earlier the documents are reviewed, the better we can assess which claims exist and what further steps make sense.
